Terms of Use

Last updated September 12, 2026

These terms cover how guests, hosts, and businesses use StaySeaside — a discovery platform that sends reservations to Airbnb, Vrbo, or a host’s own booking page.

Agreement to these terms

These Terms of Use (“Terms”) are a contract between you and StaySeaside LLC (“StaySeaside,” “we,” “us,” or “our”) for use of StaySeaside at stayseaside.com and related services. By creating an account, clicking to agree, or using the site, you accept these Terms and our Privacy & Cookie Policy.

If you use StaySeaside on behalf of a business, you represent that you have authority to bind that business.

What StaySeaside is — and is not

StaySeaside is a curated discovery layer for Jersey Shore stays, towns, events, and local businesses. Guests explore listings, chat with Crew, save stays, and message hosts. Hosts and businesses publish profiles so the right guests can find them.

We are not a booking marketplace. We do not process stay reservations, collect guest rent, or take a commission on bookings. When you are ready to reserve, we send you to the host’s Airbnb, Vrbo, or direct booking page. That third party — not StaySeaside — is the booking platform, payment processor, and party to the rental contract, together with the host.

Accounts

You must be at least 18 to create an account. Keep your login details under your control. You are responsible for activity on your account.

You may sign in with an email one-time code, Google, or Apple. You agree that the email and profile information those methods provide is accurate. We may suspend or close accounts that are shared, automated in an abusive way, or used to violate these Terms.

Guests

Guests may browse public pages without an account. Signing in unlocks Crew, saved stays, messaging, and trip-planning history. Guest use of StaySeaside is free.

Listing details, availability, prices, house rules, and cancellation terms shown on StaySeaside are provided by hosts or imported from their other listings. Confirm everything on the booking site before you pay. A message thread on StaySeaside is not a reservation.

Hosts and businesses

Hosts pay a subscription to list stays and use host tools. Plan features, listing caps, and prices are described on the host page and in your dashboard at the time you subscribe. Local businesses may have separate profile tools as we roll them out.

If you list on StaySeaside, you represent that:

  • You have the legal right to advertise the property or business.
  • Your photos, descriptions, reviews, reels, and imported content are accurate and that you have the rights needed to publish them.
  • You will keep booking links, calendars, and guest policies current.
  • You comply with local laws, taxes, permits, safety rules, and platform rules on Airbnb, Vrbo, or your direct booking site.
  • You will not use StaySeaside to collect stay payments that should run through your booking channel.

We review listings before they go live and may request changes, pause, or remove content that does not meet our quality or legal standards.

Your content

You keep ownership of content you submit (listing copy, photos, messages, Crew prompts, reviews you import, and similar). You grant StaySeaside a worldwide, non-exclusive, royalty-free license to host, display, adapt for layout, and distribute that content on StaySeaside and in our emails and marketing of the platform, for as long as it remains on the service.

You are responsible for imported Airbnb and Instagram material. Do not import another person’s listing or reviews unless you are authorized to use them. We may remove content that appears infringing, misleading, or unlawful.

Bookings and third-party sites

“Stay here,” booking buttons, and similar links leave StaySeaside. Airbnb, Vrbo, a host’s own site, Google Maps, Instagram, and other destinations have their own terms and privacy policies. StaySeaside is not a party to the rental, is not the host, and is not responsible for the stay, refunds, damage claims, or guest screening performed on those platforms.

If a listing is inaccurate or a booking goes wrong, work it out with the host and the booking platform. We can help with how StaySeaside displayed the stay, but we cannot cancel or refund a reservation we did not process.

Host subscriptions and billing

Host plans are billed in advance through Stripe on the monthly or annual interval you choose. Subscriptions renew automatically until you cancel in the host dashboard or through Stripe’s customer portal, where available. Canceling stops the next renewal; it does not usually refund the current period unless required by law or we say otherwise in writing.

Failed payments, expired cards, or plan limits may pause listings or host tools until billing is resolved. Prices and plan details may change; we will describe material changes in the product or by email. Taxes may apply. StaySeaside does not take a cut of guest booking revenue.

Messaging

Messaging is for questions about a stay or business — dates, fit, amenities, and local tips. It is not a payments channel and not a confirmed booking. We may email you when there is a new message and keep a copy of the thread so both sides can see it.

Do not use messaging for spam, harassment, scams, or to move people onto unsafe payment methods. We may rate-limit or disable messaging that looks abusive.

Crew and other AI features

Crew uses OpenAI to answer trip-planning questions and recommend stays, towns, and local picks. Hosts may also use AI to rewrite a listing description. AI output can be outdated, incomplete, or incorrect. You still need to verify facts, availability, prices, accessibility, and house rules with the listing and the booking site.

Crew is not a travel agent, insurer, or licensed advisor. Rate limits and conversation length limits apply. Do not rely on Crew for emergencies, legal advice, or binding commitments.

Acceptable use

You agree not to:

  • Break the law or infringe anyone’s rights.
  • Post false listings, fake reviews, or misleading booking links.
  • Scrape, harvest, or bulk-export the site beyond ordinary browsing, except with our written permission.
  • Probe, disrupt, or overload our systems, or bypass rate limits and access controls.
  • Upload malware or content that is hateful, pornographic involving minors, or that we reasonably consider harmful.
  • Impersonate StaySeaside, a host, or another guest.

StaySeaside intellectual property

The StaySeaside name, logos, design, software, editorial guides, and compilation of listings are owned by StaySeaside LLC or our licensors. You may not copy the site, our brand, or our editorial content except as needed to use the service.

If you believe content on StaySeaside infringes your copyright, email support@stayseaside.com with a description of the work, the URL, and your contact details.

Disclaimers

StaySeaside is provided “as is” and “as available.” We do not warrant that listings are complete, that Crew is accurate, that the site will be uninterrupted, or that a stay will meet your expectations. Hosts, guests, and third-party platforms are independent of StaySeaside.

To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, StaySeaside LLC and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost stays, or lost data, arising from your use of StaySeaside or from any booking made off-platform.

Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us for host subscriptions in the 12 months before the claim or (b) one hundred U.S. dollars ($100). Some states do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.

Indemnification

You will defend and indemnify StaySeaside against claims, damages, and reasonable legal fees arising from your content, your listings, your use of messaging or Crew, your listings’ booking arrangements, or your violation of these Terms or applicable law.

Suspension and termination

You may stop using StaySeaside at any time and can ask us to delete your account. We may suspend or terminate access if you violate these Terms, if a listing is harmful or unlawful, if billing fails, or if we discontinue the service. Provisions that should survive (including content licenses already exercised, billing already due, disclaimers, and liability limits) remain in effect.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Courts located in New Jersey will have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect our intellectual property or the service.

Changes to these terms

We may update these Terms as the product evolves. The “Last updated” date will change when we do. If a change is material, we will provide additional notice where required (for example, in the product or by email). Continued use after the effective date means you accept the new Terms.
